In May 2016, the FDA finalized a "deeming rule" extending its authority to all tobacco products, including e-cigarettes, introduced since Feb. 15, 2007. Certain aspects of the "deeming rule" were set to become effective on Aug. 8, 2016. However, with the Trump administration and new FDA Commissioner Scott Gottlieb at the helm, the "deeming rule" may evaporate as quickly as e-cigarette vapor....
