A litigious Taiwanese mattress company failed on Monday to persuade any judges on the Federal Circuit to pump any more air into two invalidated patents that have been cited in a legal campaign in the Eastern District of Texas that has targeted retail brands like Bed Bath & Beyond and Walmart.

The Patent Trial and Appeal Board agreed to review an air mattress patent challenged by Walmart Inc. and other companies, rejecting on Monday arguments that it shouldn't tolerate the petitioners' "shotgun approach" to inter partes review.
