Order (Service Packet) ~Util - Terminate Motions
ORDER (Service Packet) granting Plaintiff's Motion for Service by United States Marshal and Motion to Extend Time for Service (Doc. 11 ). The time for completing service shall be extended sixty (60) days from the date this Order is filed. The Clerk of Court must send Plaintiff a service packet including the Complaint, this Order, and both summons and request for waiver form for Defendant. Plaintiff must complete and return the service packet to the Clerk of Court within 21 days of the date of filing of this Order. If Plaintiff does not either obtain a waiver of service of the summons or complete service of the Summons and Complaint on the Defendant within 60 days of the filing of this Order, the action may be dismissed as to the Defendant for failure to timely serve. Defendant must answer the Complaint or otherwise respond by appropriate motion within the time provided by the applicable provisions of Rule 12(a) of the Federal Rules of Civil Procedure.
