DOL Asks 11th Circ. To Let New H-2B Rules Take Effect

Law360, New York (July 12, 2012, 7:26 PM EDT) -- The U.S. Department of Labor on Tuesday urged the Eleventh Circuit to overturn a preliminary injunction barring it from implementing new H-2B visa rules, saying it was based on an incorrect analysis of the agency's authority to issue the regulations.

U.S. District Judge M. Casey Rodgers handed down the injunction in April, shortly before the updated rules governing the administration of the temporary, nonagricultural, foreign worker program were scheduled to take effect.
