Liability Insurance May Cover Intentional Acts In Penn.

However, some deliberate and intentional conduct (like defamation) is expressly covered under many liability insurance policies, and such policies also provide coverage for intentional acts that cause bodily injury or property damage when the injury or damage flowing from those acts was unintended. The availability of coverage for intentional conduct resulting in an unintended injury was reaffirmed recently in Erie Insurance Exch. v. Moore, No. 869 WDA 2016, 2017 Pa. Super. 372 (Nov. 22, 2017), where the Pennsylvania Superior Court considered whether Erie Insurance Exchange was obligated to defend the estate of Harold Eugene McCutcheon in a bodily injury lawsuit involving a shooting....
