1st Circ. Revives Suit V. DaimlerChrysler

Law360 (May 6, 2009, 12:00 AM EDT) -- A federal appeals court has reversed a grant of partial summary judgment in favor of DaimlerChrysler AG, finding that a product liability suit should proceed against the automaker even though the plaintiffs made the mistake of initially naming DaimlerChrysler Corp. as the defendant.

The question raised on appeal was whether an amended complaint that changes the identity of a named defendant after the expiration of the applicable limitations period relates back to the date of the initial filing of the action.
