9th Circ. Trims Benefits Claims In Trucking Co. Ch. 11

Law360 (May 7, 2009, 12:00 AM EDT) -- A federal appeals court has ruled that benefits for retirees of bankrupt Consolidated Freightways Corp. can't be considered in determining priority claims for contributions to a health insurance plan administered by Aetna Inc.

A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit issued an opinion Wednesday partially reversing a ruling by the U.S. Bankruptcy Court for the Central District of California, which was also affirmed by the U.S. District Court for the Central District of California.
