USPTO Defends Fed. Circ. Patent Test At High Court

Law360, New York (January 23, 2018, 8:44 PM EST) -- The U.S. Patent and Trademark Office on Monday defended a Federal Circuit ruling that found claims in a Nidec Motor Corp. air conditioning patent were obvious, telling the U.S. Supreme Court that complaints the appeals court imposed a rigid test were “unfounded.”

Solicitor General Noel J. Francisco, representing the USPTO, filed the response a little more than two months after Nidec asked the justices to overturn a ruling that affirmed a Patent Trial and Appeal Board decision finding claims in its patent were invalid.
