Supreme Court Asks Indian Government To Oppose Monsanto Patent At EPO

Law360, New York (February 23, 2004, 12:00 AM EST) -- India’s Supreme Court has asked the government to file a petition at the European Patent Office challenging the granting of patent rights to U.S. agro-biotech multinational Monsanto on traditional Indian wheat landrace, Nap Hal.

A two-judge bench consisting of Chief Justice VN Khare and justice SH Kapadia on Monday asked the government to file within two weeks its response to a complaint filed by the New Delhi-based Research Foundation for Science, Technology and Ecology and environmental activist Vandana Shiva.
