Leegin May Kill Off Discount Retailers: Opponents

Law360, New York (May 12, 2009, 12:00 AM EDT) -- Proponents of a bill to undo the effects of the U.S. Supreme Court’s ruling in Leegin v. PSKS Inc. told U.S. senators Tuesday that the 2007 landmark decision could herald the end of the discount retailer.

“What is so poisonous about Leegin is that going forward there will be no more Burlington Coat Factories, there will be no more Costcos, there will be no more Walmarts,” Federal Trade Commissioner Pamela Jones Harbour told a Senate Judiciary subcommittee. “That is the danger.”
