Privilege Still Under Pressure, Corporate Counsel Say

Law360, New York (May 14, 2009, 12:00 AM EDT) -- Efforts to protect attorney-client privilege in recent years have gained ground, but many in-house attorneys are still worried about gaps in protections where companies risk disclosing information that could later be used against them.

Auditors under pressure to ensure accurate financial audits continue to seek a wide range of information from their corporate clients, including analyses of litigation exposures that could end up in the hands of third-party litigants if the privilege for such information were deemed waived.
