Atty Fee Fight Isn't Proper E&O Claim: 11th Circ.

Law360, New York (May 15, 2009, 12:00 AM EDT) -- The U.S. Court of Appeals for the Eleventh Circuit has affirmed a district court's opinion releasing Great American Insurance Co. from any duty to defend two Alabama attorneys who claim their underlying fee dispute with an auto dealer is covered by professional liability insurance.

The case centers on a professional liability policy issued by Great American to lawyers Thomas E. Baddley Jr. and Jeffrey P. Mauro of Baddley and Mauro LLC.
