Importer, Cigar Co. Denied Dismissal Of $3M Tax Suit At CIT

Law360 (March 8, 2018, 9:42 PM EST) -- The Court of International Trade denied bids by a cigar company and an importer to dismiss claims they failed to pay more than $3 million in excise taxes on cigars imported from the Dominican Republic on Wednesday, saying the federal government has sufficiently pled its case.

Judge Claire R. Kelly said the federal government has adequately alleged that cigar company Good Times USA LLC participated in a scheme with Maverick Marketing LLC, importer of record, in which Maverick acted as a so-called pass-through entity for Good Times' purchases of cigars from Dominican exporter Rolida Investments Inc., and kept the lawsuit alive....
