Insurer Claims No Duty To Cover Atty Sued For Fraud

Law360, New York (May 18, 2009, 12:00 AM EDT) -- Medmarc Casualty Insurance Co. has asked a federal court to decide the insurer does not have to cover a slew of malpractice suits launched against a real estate lawyer by Wachovia NA, Fifth Third Bank and others accusing him of fraud and conversion.

Medmarc filed a motion for summary judgment in the U.S. District Court for the Middle District of Florida on Monday seeking to determine its obligations under an insurance policy with Jerome D. Mitchell and his law firm, Jerome D. Mitchell PA.
