Toolmaker Violated ADA In Firing Salesman: 8th Circ.

Law360, New York (May 19, 2009, 12:00 AM EDT) -- A specialty toolmaker violated the Americans with Disabilities Act by firing an epileptic salesman for a perceived disability, a federal appeals court has affirmed, rejecting the argument that his subsequent receipt of Social Security benefits proved he couldn't do his job.

On Monday, the U.S. Court of Appeals for the Eighth Circuit affirmed a jury's decision against Good Earth Tools Inc. that found it had violated the ADA by terminating Thomas M. Finan because of his “perceived disability.”
