Bid To Revive Termite-Killer Antitrust Case Denied

Law360, New York (May 21, 2009, 12:00 AM EDT) -- Plaintiffs who sued Bayer Corp. and others alleging a conspiracy to fix prices of termite-killing products are considering appealing or filing new suits, after a judge rejected their claim that a decision to grant summary judgment to the defendants should have only meant a partial dismissal of the case.

Judge Lacy Thornburg of the U.S. District Court for the Western District of North Carolina signed off on an order on Tuesday denying the plaintiffs' motion to correct judgment and for relief from judgment.
