Epistar Wins Plea To Challenge LED Patent Validity

Law360 (May 22, 2009, 12:00 AM EDT) -- A federal appeals court panel ruled Friday that Taiwanese company Epistar Corp., which was found to have infringed a patent owned by a Royal Philips Electronics NV unit, could go back and challenge the validity of that patent.

The U.S. Court of Appeals for the Federal Circuit said in its opinion that the U.S. International Trade Commission erred as a matter of law in stopping Epistar from arguing invalidity of the patent when asserted against its products, but correctly construed the claim terms "transparent window layer"...
