Licenses Cover Goods Made By 3rd Party: Fed. Circ.

Law360 (May 22, 2009, 12:00 AM EDT) -- Licenses to make, use and sell a patented product carry implied licenses to have the product made by a third party unless a license explicitly states otherwise, a federal appeals court has ruled in a patent infringement and breach of contract case brought by CoreBrace LLC against Star Seismic LLC.

The U.S. Court of Appeals for the Federal Circuit on Friday upheld the case's dismissal by the U.S. District Court for the District of Utah.
