NLRB’s Authority Questioned In Supreme Court Bid

Law360 (May 26, 2009, 12:00 AM EDT) -- A federal appeals court’s decision that the National Labor Relations Board has authority to issue rulings on cases with only two sitting members is being challenged in a bid to the U.S. Supreme Court.

New Process Steel LP on Friday filed a petition seeking the high court's review of a May 1 ruling by the U.S. Court of Appeals for the Seventh Circuit.

The ruling dealt New Process a blow in its unfair labor practice dispute, holding that two-member NLRB decisions were perfectly acceptable.
