Fed. Circ. Reverses Noninfringement Ruling For SMC

Law360 (May 26, 2009, 12:00 AM EDT) -- A federal appeals court has overturned a holding by an administrative law judge at the U.S. International Trade Commission that SMC Corp.’s devices used in compressed-air systems and imported into the U.S. do not infringe Norgren Inc.’s patent.

The U.S. Court of Appeals for the Federal Circuit on Tuesday concluded that the ALJ improperly read a limitation into the patent claims. The appeals court reversed the determination of noninfringement, vacating the finding of nonobviousness and remanding the case.
