American Home Escapes Liability For Sewer Repairs

Law360, New York (May 27, 2009, 12:00 AM EDT) -- A federal appeals court has struck down a $7.7 million judgment for Insituform Technologies Inc., ruling that American Home Assurance Co. — which issued an excess umbrella policy to the contractor — is not liable for repair and replacement costs Insituform incurred working on a sewer in Boston.

The U.S. Court of Appeals for the First Circuit on Friday vacated the district court's finding of summary judgment for Insituform in its breach of contract suit against American Home and remanded the case for dismissal.
