10th Circ. Finds GenRe Dispute Should Be Arbitrated

Law360 (May 27, 2009, 12:00 AM EDT) -- A federal appeals court has held that Mid-Continent Casualty Co.’s suit against General Reinsurance Corp. over a reinsurance contract dispute should go to arbitration instead of a district court, reversing a lower court's finding.

The U.S. Court of Appeals for the Tenth Circuit on Friday reversed the U.S. District Court for the Northern District of Oklahoma's decision rejecting GenRe’s bid to compel arbitration, determining that a recent amendment to state legislation permitted arbitration in reinsurance contract spats.
