5th Circ. Sends Cargo Damage Suit To UK

Law360, New York (May 28, 2009, 12:00 AM EDT) -- A forum selection clause on a bill of lading has held up to the scrutiny of a federals appeals court, which will force twine maker Ambraco Inc. and its insurer Great American Insurance Co. to travel to London to fight a multimillion-dollar cargo damage dispute.

In a ruling issued Thursday, the U.S. Federal Court of Appeals for the Fifth Circuit said it had no reason to overturn a forum selection clause on a bill of lading issued by shipper Bossclip BV.
