Titan Loses Injunction Appeal In Tire Patent Suit

Law360, New York (June 3, 2009, 12:00 AM EDT) -- A federal appeals court has upheld a decision denying Titan Tire Corp. a preliminary injunction in a case it brought against Case New Holland Inc. and other companies for allegedly infringing a tractor tire design.

The U.S. Court of Appeals for the Federal Circuit on Wednesday ruled that the lower court had not abused its discretion in concluding that the plaintiffs had failed to show that they were likely to withstand a validity challenge on obviousness grounds.
