Alaska Construction Co. Fights Corps Over Mining Site

Law360, New York (June 5, 2009, 12:00 AM EDT) -- Arguing that the U.S. Army Corps of Engineers erroneously asserted jurisdiction under the Clean Water Act over a gravel mining site, an Alaskan construction company has asked that a permit issued by the corps be voided so that the land-use restrictions no longer apply.

In a complaint filed Wednesday in the U.S. District Court for the District of Alaska, Great Northwest Inc. is seeking declaratory judgment that the Corps of Engineers lacks the authority to regulate the company under the CWA.
