Seed Cos. Seek $12M In Attys' Fees In Bayer IP Suit

Law360, New York (June 5, 2009, 12:00 AM EDT) -- Dow AgroSciences LLC and Pioneer Hi-Bred International Inc. are looking to collect more than $12 million in attorneys' fees that they allegedly incurred in defense of a lawsuit brought by Bayer BioScience NV over insect-resistant corn patents.

Dow and Pioneer have asked the U.S. District Court for the Middle District of North Carolina for an order designating the action an “exceptional” case. Dow is seeking about $5.1 million in fees and Pioneer is seeking about $7.1 million in fees.
