Patent Term Adjustment Suit Stayed For Key Appeal

Law360, New York (June 5, 2009, 12:00 AM EDT) -- EBI Food Safety BV and defendant John J. Doll, the acting director of the U.S. Patent and Trademark Office, on Friday consented to stay EBI's patent term adjustment lawsuit pending the outcome of an appeal in a related case.

EBI's lawsuit, filed April 20 in the U.S. District Court for the District of Columbia, claims a patent term adjustment by the USPTO was erroneous and seeks, as a result, to have its patent extended by more than a year.
