Supreme Court To Hear Bankruptcy Law Challenge

Law360, New York (June 8, 2009, 12:00 AM EDT) -- The U.S. Supreme Court will hear the federal government's objection to an appellate court decision striking down as unconstitutional a provision of a 2005 law barring lawyers from advising clients to incur more debt before filing for bankruptcy.

The Supreme Court on Monday granted the petition for a writ of certiorari filed by the solicitor general of the U.S. Department of Justice, in a case involving law firm Milavetz Gallop & Milavetz PA's challenge to the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005....
