What PTAB Attys Need To Know About Real Parties-In-Interest

Law360 (June 15, 2018, 9:05 PM EDT) -- Companies challenging a patent at the Patent Trial and Appeal Board may find themselves with an unexpected headache or, worse, undermine their entire case if they fail to name all the parties that have an interest in the proceeding.

The PTAB can only consider a petition seeking inter partes review of a patent if it identifies all the interested parties. This helps the board to flag potential conflicts and controls how broadly America Invents Act estoppel provisions apply after the review concludes.
