Fed. Circ. Gives FMC Victory Over Rival In Patent Spat

Law360, New York (June 9, 2009, 12:00 AM EDT) -- Chemical company FMC Corp. has won a partial victory over rival Ecolab Inc. in a fight over meat sanitizing patents, now that a federal appeals court has overruled trial judges and reversed several jury findings.

The trial court erred several times in denying FMC's motions for judgment as a matter of law, Judge Arthur Gajarsa said in an opinion issued Tuesday by the U.S. Court of Appeals for the Federal Circuit.
