Tempur-Pedic Blankets Rivals With Foam Patent

Law360 (June 10, 2009, 12:00 AM EDT) -- Tempur-Pedic Management Inc. has filed suit against a slew of rival mattress companies and competitors, including Sealy Corp. and Serta Inc., for allegedly infringing a patent covering form-fitting foam mattresses.

The complaint, lodged Wednesday in the U.S. District Court for the Western District of Virginia, claims the roughly 16 defendants sell mattresses, cushions and the like incorporating Tempur-Pedic’s patented visco-elastic foam materials.

The assorted defendants infringe U.S. Patent Number 7,507,468, titled “Laminated visco-elastic support,” and issued on March 24, 2009, according to the complaint.
