W.Va. Wind Farm Violates ESA: Bat Lovers

Law360, New York (June 11, 2009, 12:00 AM EDT) -- A proposed 124-turbine wind farm in the Allegheny Mountains of West Virginia is under fire from an animal rights group and other adversaries alleging the project imperils the Indiana bat in violation of the Endangered Species Act.

Animal Welfare Institute and Mountain Communities for Responsible Energy filed suit Wednesday in the U.S. District Court for the District of Maryland, claiming the project developers failed to obtain an incidental take permit for the Beech Ridge wind farm even though it clearly threatens endangered Indiana bat populations....
