4th Circ. Revives Suit Against Atty Over Snuff Deal

Law360, New York (June 12, 2009, 12:00 AM EDT) -- A federal appeals court has revived a lawsuit accusing the former plaintiffs’ counsel in a consumer class action against U.S. Smokeless Tobacco Co. of abandoning his clients’ interests and surreptitiously altering a settlement for his own benefit.

Judges Paul V. Niemeyer, M. Blane Michael and Eugene E. Siler Jr. of the U.S. Court of Appeals for the Fourth Circuit reversed the dismissal of the claims and faulted the lower court for declining jurisdiction.
