Philips Accuses Pulse Oximeter Patent Rival Of Tying

Law360, New York (June 15, 2009, 12:00 AM EDT) -- Philips Electronics North America Corp. has fired back in a patent lawsuit over pulse oximeters, with claims that patent-holder Masimo Corp. has tried to illegally dominate the market for the medical devices.

Masimo allegedly employs a proprietary system in its devices, with no purpose but to hamper competition in contravention of the Sherman and Clayton acts, Philips said in an answer filed Monday in the U.S. District Court for the District of Delaware.
