DuPont Slaps Monsanto With Antitrust, Patent Claims

Law360, New York (June 16, 2009, 12:00 AM EDT) -- Striking back at Monsanto Co.’s infringement suit against it, DuPont Co. asserted claims Tuesday that the agricultural giant’s patent on herbicide-resistant genetically modified soybeans and corn is invalid and that the litigation is an attempt to restrict competition in the market for genetically altered seeds.

DuPont filed counterclaims in the U.S. District Court for the Eastern District of Missouri, alleging Monsanto’s Roundup Ready technology is not being infringed and that the suit is part of Monsanto’s anti-competitive scheme to block farmers’ access to rival agricultural products....
