Circuit Court of Appeals, Judge Brett Kavanaugh has written an opinion that may strengthen attorney-client privilege over communications between a company and its in-house counsel. In Federal Trade Commission v. Boehringer Ingelheim Pharmaceuticals Inc., a three-judge panel ruled that attorney-client communications can have "multiple purposes" and still be privileged as long as "legal advice was one of the significant purposes of the communications."[1] This D.C. Circuit opinion clashes with case law in other circuit courts that have applied attorney-client privilege more restrictively....
