1st Circ. Revives Suit Over Suzuki Motorcycle

Law360, New York (June 23, 2009, 12:00 AM EDT) -- An appeals court has reinstated a rider's complaint against Suzuki Motor Corp. alleging that its GSX/1300R motorcycle has a manufacturing defect that can cause the frame to split in two, ruling that he filed his suit within the applicable one-year statute of limitations for tort actions under Puerto Rico law.

The ruling Monday by a three-judge panel of the U.S. Court of Appeals for the First Circuit reversed a lower court's dismissal of plaintiff Orlando Rodriguez's claims that the alleged defect caused the injuries he sustained...
