Full Fed. Circ. Urged To Rehear Network IP Suit Against Yahoo

Law360 (September 6, 2018, 9:15 PM EDT) -- TS Patents LLC has asked the full Federal Circuit to revive its patent infringement suit over computer network capabilities against Yahoo Inc., arguing the panel should not have upheld the lower court's dismissal because Federal Circuit precedent limits judges' ability to nix certain patents at the pleading stage.

TS urged the appeals court to review en banc the panel's decision last month upholding the dismissal of TS' patent infringement claims, pointing to two other Federal Circuit rulings earlier this year that limited judges' abilities to nix patents under the U.S. Supreme Court's Alice decision in the beginning stages of litigation....
