Water Board's Merck Discharge Limit Appealed

Law360, New York (June 29, 2009, 12:00 AM EDT) -- Two environmental groups are appealing the Virginia State Water Control Board's decision to allow Merck & Co. Inc. to increase its nitrogen and phosphorous discharges into the Shenandoah-Potomac River Basin, saying the pollutants are more than the river can handle.

The Chesapeake Bay Foundation and the Virginia State Waterman's Association on Monday appealed in the Circuit Court for the City of Richmond the board's April 27 approval of amendments to the Virginia Water Quality Management Planning Regulation.
