Ex-Qwest Accountant Fights SEC's Fraud Claims

Law360, New York (June 30, 2009, 12:00 AM EDT) -- A former Qwest Communications International Inc. accountant has urged a court to toss the U.S. Securities and Exchange Commission's fraud case against him, arguing he was a junior executive with no power.

In a 78-page motion for summary judgment filed Tuesday in the U.S. District Court for the District of Colorado, the one-time Qwest executive, James Kozlowski, claimed he had no authority over Qwest's allegedly fraudulent public filings and was just following orders.
