By Nancy Linck (October 15, 2018, 2:56 PM EDT) -- At the Intellectual Property Owners Association's annual meeting on Sept. 24, 2018, Andrei Iancu, director of the U.S. Patent and Trademark Office, announced that the USPTO is planning to propose guidance to address the challenges with patent examination under 35 U.S.C. § 101 created by the courts' interpretation of the statute.[1] While acknowledging that proposed § 101 legislation has been drafted to address those challenges, according to Director Iancu, "the USPTO cannot wait" for such legislation to be enacted.[2]...
