Sanofi-Aventis Scores Trademark Victory

Law360 (September 28, 2006, 12:00 AM EDT) -- Though it still faces an onslaught of Plavix litigation, Sanofi-Aventis received some good news on Thursday when a federal court in Delaware handed down a trademark ruling in favor of the French pharmaceutical company.

Aventis Pharmaceutical Corp., now a part of Sanofi-Aventis, filed the lawsuit in Dec. 2003 against upstart Advancis Pharmaceutical Corp. claiming that the name of the company was “confusingly similar” phonetically and visually to its own.

Aventis alleged that Advancis would use its trademark to unfairly compete in the market for antibiotics....
