Judge Boots Duke Coal Plant Fight From Fed. Court

Law360, New York (July 6, 2009, 12:00 AM EDT) -- A federal judge has dismissed a lawsuit objecting to a Duke Energy Corp. coal-fired power plant, saying the environmental groups fighting the facility have filed a near-identical action with the North Carolina Office of Administrative Hearings.

On Thursday, Judge Lacy Thornburg of the U.S. District court for the Western District of North Carolina dismissed a Clean Air Act lawsuit against Duke Energy subsidiary Duke Energy Carolinas LLC.
