AmEx Delay In CBM Patent Challenge No Problem, PTAB Says

Law360 (November 2, 2018, 5:49 PM EDT) -- The Patent Trial and Appeal Board agreed Thursday to review a patent for a rewards points program that American Express Co. argues is directed to only an abstract idea, rejecting arguments there was an "undue delay" in AmEx's bringing the challenge.

The PTAB said it would institute America Invents Act covered business method review of the Signature Systems LLC patent after finding AmEx was likely to succeed in its argument that several of the patent's claims are invalid.

The patent covers a system that allows a user to purchase goods or services using awards points.
