Flonase Antitrust Claims Survive GSK's Dismissal Bid

Law360, New York (July 7, 2009, 12:00 AM EDT) -- A judge has denied GlaxoSmithKline PLC's request to dismiss an antitrust suit over the drug Flonase, finding that the plaintiff, generic-drug maker Roxane Laboratories Inc., was able to sufficiently allege that GSK's actions delayed Roxane's sale of a generic version of the nasal spray medication.

Judge Anita B. Brody issued the order Tuesday in the U.S. District Court for the Eastern District of Pennsylvania in the antitrust suit filed by Roxane, which has been consolidated in a multidistrict litigation with proposed class actions filed against GSK...
