Nationwide On Hook For Katrina Rain Damage Claims

Law360, New York (July 8, 2009, 12:00 AM EDT) -- A federal judge has axed some of Tab Industries Inc.'s claims against Nationwide Mutual Insurance Co. but left intact central allegations that the carrier stiffed the industrial supply company on coverage for damages caused by Hurricane Katrina.

On Monday, Judge L.T. Senter Jr. of the U.S. District Court for the Southern District of Mississippi dismissed Tab’s allegations of fraud and breach of fiduciary duty as well as claims relating to structural damage the hurricane caused to Tab’s facility in Pascagoula, Miss.
