Fed. Circ. Won't Reconsider Nixing Robotics IP Under Alice

By Matthew Bultman (November 26, 2018, 4:46 PM EST) -- The Federal Circuit has refused to reconsider its September ruling that parts of four robotics patents asserted against Invensys Systems Inc. and other automation companies are invalid under the U.S. Supreme Court's Alice test.

The appeals court on Nov. 21 denied a request from Automation Middleware Solutions Inc. to rehear the case en banc, leaving in place a ruling that affirmed a judge's decision that claims in AMS' patents cover patent-ineligible abstract ideas under Alice.

In asking for the case to be reheard, AMS argued the ruling clashed with other recent Federal Circuit decisions, including one that made it more difficult...
