Purdue Must Face Alpharma OxyContin Patent Claims

Law360, New York (July 10, 2009, 12:00 AM EDT) -- Purdue Pharma LP, the drugmaker behind OxyContin, has lost its bid to throw out a lawsuit by Alpharma Inc. seeking to declare several of its rival's patents covering the controversial painkiller invalid and noninfringed.

Judge James P. Jones of the U.S. District Court for the Western District of Virginia on Thursday denied Purdue's motion to dismiss Alpharma's lawsuit for lack of subject matter jurisdiction.

He also shot down the pharmaceutical company's request to transfer the case to Connecticut, where Purdue is based.
