5th Circ. Rebuffs Chevron Contamination Suit Again

Law360, New York (July 12, 2009, 12:00 AM EDT) -- A federal appeals court has refused to reconsider its earlier ruling that the owners of a defunct sugarcane farm in Louisiana cannot sue Chevron USA Inc. for allegedly contaminating the site, finding that the owners failed to establish an exception to their claims being time-barred.

The U.S. Court of Appeals for the Fifth Circuit on Friday denied Kling Realty Co. and Walet Planting Co.'s petition for rehearing, although the appeals court vacated its previous opinion and replaced it with a new one.
