High Court Passes On UnitedHealth Antitrust Appeal

Law360 (October 2, 2006, 12:00 AM EDT) -- The United States Supreme Court on Monday declined to hear an appeal from UnitedHealth Group Inc. over whether doctors can bring antitrust challenges in court against health care providers over reimbursement rates, rather than go to arbitration.

The Ohio State Supreme Court, from which the case was appealed, ruled that Ohio doctors can pursue their claims in court.

UnitedHealth argued that the doctors were bound by clauses in their insurance agreements to duke out their complaints in arbitration.
